The Texas Legislature enacted two laws to combat deed fraud and strengthen notary practices tied to real-property documents.

SB 1734 — Fast-track relief from fraudulent filings

  • Owner’s affidavit + notice: A property owner who believes a recorded document fraudulently conveys title or an interest may record an owner’s affidavit and mail notice to the grantor and grantee. If no controverting affidavit is recorded within 120 days, the owner may petition the district court for a finding that the document does not convey title. The statute provides suggested forms for the affidavit, petition, and judicial finding.
  • Presumption of fraud: A document is presumed fraudulent if it’s tied to a relevant criminal conviction or if it’s the subject of an uncontroverted owner’s affidavit.
  • Streamlined court action: The court may act ex parte based on the filings and public records; filing fees are waived, and the court’s finding is recorded so bona fide purchasers and mortgagees may rely on it. (Effective Sept. 1, 2025.)

SB 693 — Stronger notary standards and penalties

  • Personal appearance offense: Creates a criminal offense if a notary performs a notarization knowing the signer did not personally appear; it’s a Class A misdemeanor, elevated to a state jail felony if the document involves the transfer of real property. (Effective Sept. 1, 2025.)
  • Education + record-keeping: Directs the Secretary of State to establish education (and continuing education) requirements; requires notaries to retain records for 10 years. Education changes apply to applications on or after Jan. 1, 2026.
